Your Compassionate Advocates in Family Legal Matters

In Texas child custody is called "conservatorship." There are three types of conservatorships and each has certain rights, duties, and access to the child(ren) depending on the type of conservatorship.

1.) Sole Managing: The parent who is named as the sole managing conservator has the sole legal right to make certain decisions concerning the child, including but not limited to medical and educational decisions.

2.) Joint Managing: With a joint managing conservatorship in Texas, the parents share rights and duties. However, exclusive rights such as the right to designate the residence of the child and the right to receive child support may be awarded to one party.

3.) Possessory: Possessory Conservators have rights to possession and access of their child, but no rights when it comes to final decision-making on the child's behalf.

In order to modify or change the type of conservatorship, a person may hire a lawyer and file a suit affecting the parent-child relationship. This type of suit can modify what is already in place or to grant rights and access to someone seeking access to a child such as a grandparent.

Suits affecting child custody can be very emotionally charged and stressful for the parties involved. Hiring an experienced attorney is crucial to understanding and navigating the process.
